These Terms & Conditions (the “Terms”) govern your access to and use of the Cofinda mobile application and related website (together, the “Service”), operated by Cofinda (“we”, “us”, or “our”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of terms

By creating an account or otherwise using the Service, you confirm that you are at least the age of majority in your jurisdiction and are legally able to enter into these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

2. Licence to use the app

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the Service for your personal, non-commercial use on a device that you own or control. All rights not expressly granted to you are reserved by us.

3. Your responsibilities

You agree not to, and not to permit others to:

• use the Service for any unlawful, harmful, or fraudulent purpose;
• copy, modify, distribute, reverse-engineer, or create derivative works of the Service;
• attempt to gain unauthorized access to the Service or its related systems;
• interfere with or disrupt the integrity or performance of the Service; or
• upload content that infringes the rights of others or violates any law.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@cofinda.io if you suspect any unauthorized use.

5. Intellectual property

The Service, including all software, text, graphics, logos, and other content (other than content you provide), is owned by us or our licensors and is protected by intellectual-property laws. These Terms do not transfer any ownership rights to you.

6. Third-party services

The Service may link to or rely on third-party services. We are not responsible for the content, policies, or practices of any third party, and your use of them may be subject to their own terms.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we discontinue the Service. Upon termination, the licence granted to you ends and you must stop using the Service.

10. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Cofinda is established, without regard to its conflict-of-laws rules.
